Welcome to FreshSTL. These terms and conditions are a contract ("Agreement") between you ("Buyer") and Yassine Bouomrine (operating and trading as FreshSTL, "Supplier", "we", "us", or "our") and govern your use of the FreshSTL website at https://freshstl.com and the purchase of digital 3D model assets (the "Products").
All checkout services, transactions, and payment processing are conducted by our authorized reseller and Merchant of Record, Whop.com (or Whop, "Whop"). By completing a Transaction on FreshSTL, you agree to these Terms and Conditions and Whop's Buyer Terms.
3.1. You agree to use the Service in accordance with applicable laws. You shall not:
3.2. You are responsible for maintaining backups of your downloaded digital files.
4.1. Payment Processing: When you complete a purchase, Whop will charge your selected payment method. We do not store or process full credit card numbers on our servers.
4.2. Taxes (VAT / Sales Tax): Because Whop is the Merchant of Record, Whop calculates, collects, and remits all applicable sales taxes, VAT, and GST based on your location.
4.3. Tax Refunds for Businesses: Business buyers with a valid VAT/Tax ID must contact Whop within 60 days of the Transaction date to request a sales tax refund if eligible.
5.1. All purchases and refund requests are governed by Whop's Buyer Terms and our Refund Policy.
5.2. 14-Day Refund Right: Buyers may request a full refund within 14 days of purchase by contacting Whop at whop.com/support or FreshSTL at support@freshstl.com.
5.3. License Revocation: Upon refund approval, access to the product download is deactivated and all licenses are cancelled.
6.1. We encourage buyers to contact Whop or FreshSTL support directly prior to filing a dispute or chargeback with their payment provider.
6.2. Fraudulent chargebacks or abuse of payment protection mechanisms will result in immediate account termination, revocation of all asset licenses, and blocking of future access.
All Products, designs, code, text, and media on FreshSTL are the intellectual property of Yassine Bouomrine (FreshSTL) or its licensors. Purchasing a Product grants a limited, non-exclusive, non-transferable license as defined in our Digital License Agreement; it does not transfer copyright ownership.
To the fullest extent permitted by law, Yassine Bouomrine (FreshSTL) and Whop shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service or downloaded digital Products.
These Terms are governed by applicable law. Disputes regarding payment processing, tax collection, or billing are governed by the provisions set out in Whop's Buyer Terms and Conditions.
